Demanded Cancellation of his candidature

Nabaz-e-Punjab Bureau, Chandigarh/Gurdaspur, 6th October:
Aam Aadmi Party Punjab has submitted a complaint to the Chief Electoral Officer Punjab against Swaran Salaria, candidate for BJP in Gurdaspur bye-elections and demanded the Cancellation of his candidature for hiding facts about the criminal case against him in the Form 26 along-with other documents/affidavits that are required to be filled while filling nomination papers before returning Officer.
Jastej Singh, Spokesperson, AAP (Punjab) in the complaint mentioned that it is being widely reported in the media that earlier an FIR u/s 376, 420, 506 IPC was filed against Sh. Swaran Salaria on a complaint made by Ms. Kamini Kaushal in 2014. AAP (Punjab) has further learned from media sources that Mr. Salaria has filed a petition in the Hon’ble High Court for quashing of the above mentioned FIR and the said petition is still pending hearing in the he added that If these facts are true then it goes a long way in proving that Mr. Salaria is guilty of concealment of material facts from the Election Commission of India. However, by deliberately concealing the facts of an FIR being pending against him, Mr. Salaria has transgressed the limits of the Constitution of India and has committed an un-pardonable offence for which clear punishment is envisaged u/s 125 (A) of the Representation of People’s Act 1951.
He further submitted that at the time of filing of the nomination, above mentioned facts were not within the knowledge of the party otherwise such glaring violation of law would have been brought to your kind notice before/on the date of scrutiny of the nominations. So the question of limitation or delay does not arise. Jastej Singh requested that keeping in view the above mentioned facts/reasons, a thorough inquiry may kindly be conducted into the veracity of the above mentioned facts as revealed by the media and if the same are found to be true then by following the spirit of the Constitution and the law as envisaged under the representation of People’s Act 1951, the candidature of Sh. Salaria should be cancelled at the earliest.
