HC confines probe into Kotkapura firing case by quashing SIT report of Kunwar Vijay Pratap: Bir Davinder Singh

Bir Davinder Singh, the former deputy speaker of Punjab Vidhan Sabha has reacted to the recent order of the High Court to form a fresh Special Investigation Team (SIT) for conducting a probe on Kotkapura firing case of 2015. He said the new SIT to investigate Kotkapura police firing in compliance with the High Court’s recent order, would be an illusory eyewash. “The SIT heavily burdened with the High Court’s explicit observation and arguably declaring the members of a ‘particular political family’ innocent, who are otherwise perceived to be the ‘back-cloth conspirator’ in the sacrilege of Sri Guru Granth Sahib shall be of no sensible use. Moreover the striking indictment of IG Kunwar Vijay Partap Singh has not only restricted the scope of the investigation; it has rather fettered the options of the SIT, yet to be constituted in the matter,” said Bir Davinder Singh.
He believed that no member of the SIT could dare to go beyond a point in contravention of the exegetic observation of the High Court; beside the unambiguous, explicit directions to be followed by the new SIT. The High Court has not liberated the new SIT of the consequential impact of some of the unequivocal observations made in the Judgment. The Judgment under discussion has not restrained the investigators from drawing inferences, under the influence of both the point wise scathing indictment of Kunwar Vijay Partap Singh IG or laissez-faire amnesty to Parkash Singh Badal and his son Sukhbir Badal, then Chief Minister and Home Minister respectively, said the former deputy speaker.
He added that the new SIT by implication was not free to probe certain areas of crime, which the SIT carrying out fair investigation may deem it necessary to investigate thoroughly to uncover the faces of all the agents’ provocateurs which may be necessary to ensure justice to the victims of the police firing.
Bir Davinder elaborated, “To my mind even going to the Supreme Court to challenge the ‘consented judgment’ would not apparently yield any fruitful result, except to further delay the delivery of justice to the victims, which is already atrociously and exceedingly delayed. It appears that the political insidiousness of the vested interests would never allow a transparent logical closure. The entire process of ‘proxy litigation’ maneuvered all through, by the vested interest in the sacrilege case of Sri Guru Granth Sahib at Bargari and subsequent incidents of police firing at Kotkapura and Behbal Kalan on the Sikh devotees, has shaken the faith of the Sikh Community in the system of Jurisprudence.”
He said that he was afraid to believe that there seems to be no hope of inclusive justice in the sacrilege of Guru Granth Sahib together with the police firing unless the people of Punjab in their collective wisdom decided to defeat the ‘Political monsters’ whose faces had already been unmasked beyond any doubt .
